Terms and conditions.
Booking Fee: A minimum booking fee of £150 for all cakes is required to confirm your booking and secure your cake date, with out this we can not hold your booking date. The remaining balance will then be due 1 month before delivery. Failure to pay the final amount on time without prior agreement may result in your order being cancelled and your booking fee and any other payments made will not be refunded.
Any changes to your order must be made 1 month before delivery, with a new quote and contract sent to confirm changes. Booking fees are to secure and hold your cake date, booking fees are non-refundable and can not be moved to hold another date, booking fees are retained to cover lost income from your cancelled or postponed date, as it can not be guaranteed your date will be rebooked.
Cancellations: Upon cancellation of original contract (cancelled or postponed dates void original contract): change of order to another booking (design or date) voids your original booking contract and a new booking contract will need to be made and original booking fee can not be moved or returned. All booking fees and postponement fees are non-refundable. A cancellation is the cancellation of the agreed cake date and or design upon which your booking fee is paid for, if a cake is to be postponed to another date a new booking fee will be needed to retain a new date and your cake design will be re-quoted closer to your new booking date. If cancellation is made 30 days or less before contracted date, you will be liable for the full amount and will be billed for the full amount, failure to pay will result in the matter being taken to small claims court. All bookings are under contract with original named customer, even where a third party payment has been made, all communication regarding the order must be made through original booking name, signed upon booking contract and agreed terms and conditions.
Collections: If collected it is the customers responsibility to ensure the safety of the cake to its required destination (Lily rose cakes will advise on the best way to do this) Cakes should only travel in the flat of a boot with nothing surrounding it.
Lily Rose cakes can not be held liable for any damage caused to the cake after it has left the premises. Once a time to collect is agreed upon, the customer must arrive within 30 minutes of agreed collection time. We can not guarantee that we will be in past this time, unless time is rearranged no less than 24 hours before collection. If the customer is unable to keep to the time agreed, contact must be made via email, phone or social media to rearrange time.
Redesigns: Any cakes requiring a redesign or revised quoting will be subject to any price increases, original quote will be void and a new quote and form will be sent for your updated design.
Fresh flowers: If fresh flowers are to be placed on the cake after delivery/collection without prior discussion, it is the responsibility of the customer and florist to determine flower safety and good food practices as some flowers may be toxic, and not the responsibility of Lily rose cakes.
Upon set up, delivery or collection of a cake:
It is always best for any items to be added safely by Lily Rose Cakes, any items including toppers and flowers added after Lily Rose Cakes has left the cake, responsibility lies upon the customer and or venue and persons who apply any unauthorised items to the cake, any damage caused or none food safe items added is no longer the responsibility of Lily Rose Cakes.
Bespoke Cake Design Ownership Terms
Design Ownership: All bespoke cake designs created by LilyRoseCakes remain the intellectual property of the designer. Any sketches, drawings, concepts, or design ideas provided to the customer are for the purpose of the commissioned cake only and may not be reproduced, copied, or used by another cake maker without prior written permission.
Copyright: All design work, including sketches, digital mock ups, and photographs of completed cakes, is protected by copyright and remains the property of LilyRoseCakes Use of Designs
Customers are purchasing the finished cake product, not the design itself. The design may not be replicated, recreated, or shared with another baker for reproduction.
Inspiration Images: If inspiration images are provided by the customer, the final cake design will still be interpreted and created uniquely by LilyRoseCakes, and the resulting design remains the intellectual property of the designer.
Portfolio & Marketing: LilyRoseCakes reserves the right to photograph and use images of all bespoke cakes and designs for promotional purposes including websites, social media, and marketing materials.
Third Party Reproduction: Any unauthorised reproduction or commercial use of the design may constitute copyright infringement.
Bespoke Cake Design Pricing: These are start from prices only and do not include any design or delivery, final quote is given upon receipt of bespoke design. Prices may vary. Prices are subject to change and may vary to prices seen on the LilyRoseCakes website, prices are not set upon booking but are given with the final form within the same year of delivery date, price points seen here are those for the current year and so may increase within your cake delivery year, final quotes are based on delivery date, prices are updated every January.
Simply Stunning Range: Simply stunning range prices may vary. Prices are subject to change and may vary upon quotation, prices are not set upon booking but are given with the final form within the same year of delivery date, price points seen on the LilyRoseCakes website are those for the current year, final quotes are based on delivery date, prices are updated every January. All cakes are delivered and set up by LilyRoseCakes only, unless previous arrangements are agreed. No other items are to be added to the cake without prior agreement due to food contamination safety.
Allergens: Unfortunately LilyRoseCakes can not provide any allergen free products, as all products are made in the same work space, I can not guarantee there will be no cross contamination. It is the responsibility of the customer to inform the cake decorator of any known allergies to any ingredients that may be used in the cakes. Cake ingredients or machinery will or may come into contact with nuts, egg, milk and wheat products. Allergen information is provided with all orders and can be found on the customer contract handed to you upon collection/delivery.
Emergency cancellations: In the very unlikely event of a severe medical, natural or other emergency, it may be necessary to retain an alternative cake decorator. We will make every effort to secure a replacement decorator. If such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for your order.
Returns & Refunds: In the unlikely event that a cake is deemed as unsatisfactory when cut the customer must keep hold of the cake for inspection by the the cake decorator. If it is agreed that the cake is not fully baked or does not contain the correct flavours as stated on the initial form, a % of the total cost will be agreed and refunded. Without the cake to be inspected no refund can be given.
Delivery Charges: Delivery is charged 50p per mile travelled to and from delivery destination. The first 20 miles to and from Roseisle, Moray are free of charge.
Delivery and set up is included in the total cost when quoted for wedding cakes. Any changes needed for delivery must be given no less than 24 hours before delivery, an extra charge will be made for changes made with less than 24 hours notice.
Terms for dummy cakes:
Upon booking a dummy cake from Lily Rose Cakes, an agreement may be made to return the dummy cake to LilyRoseCakes which will entitle you to the refund of your cake booking fee, or previously agreed amount. Upon agreement Lily Rose Cakes will collect the cake from your venue. It is the responsibility of the customer to ensure the cake is returned in the same state that the cake was delivered, the cake must still be in one piece with all details, design and any flowers/toppers still intact, any damage or marks may result in a partial or none refund. Items to be kept by the customer may be removed upon agreement with Lily Rose Cakes. A refund will be issued once the cake has been returned and inspected by Lily Rose Cakes.
Terms relating to hired items. Upon hiring any items from Lily Rose Cakes (cake stands etc) a minimum security deposit of £25 will be taken, this will be held until hired items are returned. If items are returned in the same condition in which they were hired with no damage, the full security deposit will be refunded. Any damaged or unreturned items: named customer will be liable for the full cost of the item to be replaced and will result in the loss of the security deposit. Prior arrangement for returning the item/items will be arranged, if collection is to be made by Lily Rose Cakes security deposit will be kept to cover travel expenses. All items must be returned within a 7 days from hire date.
Terms relating to the corona virus and or any future pandemics or national emergencies, related laws and any other postponements/cancellations:
If a booking is unable to go ahead at all because gatherings of any kind are not permitted by law on the day of customers booking, all paid fees will be moved to your new date. (This is only in regards to not being able to hold the ceremony or party at all with zero guests allowed) In the case of the wedding or party being able to go ahead but the customer chooses to postpone or cancel their celebration, all fees are non-refundable.
If a postponement is made and Lily Rose Cakes is able to move to your new date, a new booking fee of £150 will need to be paid and a new booking contract will be given, all previous booking fees will be retained. Postponing a date is in effect cancelling your previous date and order and a new contract and booking will need to be made to secure your new date.
If full payment has been made and postponement/cancellation has been made over a month before booking date, this can be moved to a new date excluding the original booking fee which will be retained. Upon cancellation over a month before booking date, the booking fee will be retained the rest will be refunded. If any items have been purchased for the cake this will also be deducted from any refund.
If a cancellation or postponement is made with less than a months notice before the celebration date, full payment will still be owed to Lily Rose Cakes.
Upon postponing if Lily Rose Cakes is unable to accommodate your new date, the booking fee is non refundable, as the booking fee is to hold original contracted dates and covers all admin and loss of business, any payment over that may be refunded if inline with other terms and conditions.
Lily Rose Cakes endeavours to help in every way possible and will work with you in making sure we can come up with a solution that will suit both parties.
